Terms and Conditions

These Terms of Service govern use of BoatBalance during beta, trial, and production use unless a separate written agreement applies.
Ownership and Operator
BoatBalance is owned and operated by GR Trade, LLC doing business as BoatBalance.
BoatBalance owns the platform, software, branding, reports, design, code, visual design, workflows, documentation, and other intellectual property associated with the BoatBalance service.
Customer and Team Data
Teams and customers own their roster, event, equipment, communications, uploaded documents, guest intake, waiver, and other team data.
By using BoatBalance, teams and users authorize BoatBalance to host, process, display, transmit, back up, secure, and otherwise use that data as reasonably necessary to provide, maintain, support, and improve the BoatBalance platform.
Lawful Use and Acceptable Use
Users must use BoatBalance lawfully, responsibly, and in accordance with these Terms.
Users may not:
- Misuse the platform
- Interfere with the security, integrity, or operation of BoatBalance
- Attempt unauthorized access to accounts, systems, data, or networks
- Upload unlawful, harmful, infringing, misleading, or deceptive content
- Violate the rights, privacy, or safety of others
- Send spam, phishing, fraudulent, deceptive, harassing, abusive, or unauthorized communications
- Use BoatBalance to send communications without appropriate consent
- Circumvent opt-out, unsubscribe, or communication preference settings
- Use BoatBalance in a way that violates messaging provider rules, carrier requirements, or applicable communications laws
- Reverse engineer, copy, scrape, resell, or exploit the platform except as expressly permitted
- Use BoatBalance in a manner that harms other users, teams, BoatBalance, or the availability of the service
Communications
BoatBalance enables authorized team administrators and coaches to communicate with members using email, SMS/text message, WhatsApp, and future app push notifications.
Communications may include account notices, invitations, reminders, schedule changes, attendance requests, safety information, trial request follow-up, and other platform or team-related messages.
SMS Messaging Terms
BoatBalance provides operational SMS/text messaging to users who have provided express consent during account registration by selecting an unchecked SMS consent checkbox.
By opting in, users agree to receive operational text messages related to their BoatBalance account and their team's activities. Messages may include practice reminders, event invitations, event updates, attendance requests, schedule changes, weather or safety notifications, account notices, and other team-related communications.
Message frequency varies depending on your team's activities and account usage.
Message and data rates may apply.
Reply STOP to unsubscribe from SMS messages at any time.
After replying STOP, users will receive a confirmation message and will no longer receive SMS messages unless they opt in again.

Carriers are not liable for delayed or undelivered messages.

Privacy
Use of BoatBalance is also governed by the BoatBalance Privacy Policy, which describes how information is collected, used, protected, and shared.
Availability of Service
BoatBalance is provided on an "as-is" and "as-available" basis. While we strive to provide a reliable and secure service, we do not guarantee uninterrupted availability, error-free operation, or that every feature will always be available in the same form.
From time to time, BoatBalance may modify, improve, replace, suspend, or discontinue features as part of ongoing development, maintenance, security, legal compliance, or service improvements.
We reserve the right to perform maintenance, updates, or other changes that may temporarily affect service availability.
Reports and Operational Decisions
BoatBalance provides tools, reports, recommendations, and operational support for teams. Coaches, administrators, and teams remain responsible for final decisions about safety, participation, lineups, equipment use, communications, and event operations.
Account Suspension and Termination
BoatBalance may suspend or terminate accounts that violate these Terms, misuse the platform, interfere with the security or operation of the service, or engage in unlawful or unauthorized activity.
Users and teams may discontinue use of BoatBalance at any time.
No Warranty
BoatBalance is provided on an "as-is" and "as-available" basis.
To the maximum extent permitted by law, BoatBalance disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and uninterrupted operation.
Limitation of Liability
To the extent permitted by law, BoatBalance and GR Trade, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, or business interruption. Liability is limited to the extent permitted by applicable law.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.
Changes to These Terms
BoatBalance may update these Terms of Service from time to time.
Updated versions will be posted on this page with the revised effective date.
Continued use of BoatBalance after changes become effective constitutes acceptance of the updated Terms.
